The Health Insurance Portability and Accountability Act of 1996 (Public Law 104-191), also known as HIPAA, was enacted as part of a broad Congressional attempt at healthcare reform. The "Administrative Simplification" aspect of that law requires the United States Department of Health and Human Services (DHHS) to develop standards and requirements for maintenance and transmission of health information that identifies individual patients.

While not specifically targeting e-mail or messaging communications as requirements under HIPAA, consent to release medical information, requests for benefits summaries, and secure access to health information may involve the use of e-mail or other electronic communications. For example, access control and secure transmission to ensure that a sent message cannot easily be intercepted by unauthorized individuals, comprehensive audit trails providing a clear indication of when and by whom any data was received or altered, and data integrity to ensure the validity of information that is stored electronically are all components required to ensure HIPAA compliance.

The Medical Conditions of Participation rules impact archiving as well.

Hospitals must retain medical records for five years and rural health clinics must retain medical records for six years.
